What You Can Expect:

Bankruptcy can be a complex process. Whether you are filing for a Chapter 7 or Chapter 13, there is an enormous amount of information that your attorney must collect from you up front in order to file the petition. Because the nature of the relief being sought by the debtor is either a total or partial discharge of one's debts, the Trustee (and Judge in a Chapter 13) want to be sure they know all there is to know about your financial circumstances before granting the relief being sought. Because of this, the Bankruptcy Code has established specific procedures for determining which type of Bankruptcy a prospective debtor may qualify for.To add a new question go to app settings and press "Manage Questions" button.

Chapter 7 Bankruptcy

There are essentially two ways to qualify for a Chapter 7 "liquidation" -- either by having income which is below the State Median Income or by qualifying under the "Means Test". What this simply means is that if your combined income is below NY State's median income, based on your family size, then you automatically qualify for Chapter 7. If your income exceeds the state's median however, then the "means test" must be employed to determine whether or not you are still able to qualify for Chapter 7. If, after deducting allowable expenses from your actual monthly income you are left with either zero or negative disposable income, then you still will qualify for Chapter 7. If that number is positive however (i.e., you still have income leftover) then you cannot file for Chapter 7 but must instead file for Chapter 13 (explained further below).

Chapter 13 Bankruptcy:

A Chapter 13 reorganization is for debtors who either do not qualify for a Chapter 7 based on income or, on the other hand, who have assets they wish to keep. Under a Chapter 13, a debtor is allowed to restructure (or reorganize) their portion of their debt into a Payment Plan for either 3 or 5 years. Under the terms of this plan, a debtor is allowed to pay off a portion of their debts with a monthly payment amount based directly on their ability to pay. This can result in reductions in payback amounts from 50% to below 5% of total debts. A good deal for most seeking bankruptcy protection.

From 2003-2005, Colin worked as an Assistant District Attorney for the Bronx County District Attorney's Office. From 2005-2015, he worked for several litigation firms throughout the Hudson Valley where I gained valuable experience in the areas of Criminal Defense, Family/ Matrimonial Law, Contract Law and Commercial Law, Insurance Defense and Commercial Liability Law, Bankruptcy Law and Landlord/ Tenant Law. Since 2015, he has practiced as a solo attorney in Westchester and the surrounding areas.

Colin holds a Bachelor of Arts in Philosophy from Cedarville University in Cedarville, OH (Class of 1996) and a Juris Doctor from Pace University School of Law in White Plains, NY (Class of 2003).
